Two weeks ago, I wrote about the pronouncements of attorney Mat Staver, of Liberty Counsel, aiming to get pastors stumping for the Religious Right in Preach for Right Wing Votes Without Fear of the IRS

This campaign is intensifying, with a new releases of Staver of Letter to Pastors, another video online (see links below), and voter guides galore.

This new Staver push was promoted by Judie Brown, president of the American Life League (ALL) in a February 12 posting, in which she says church involvement in the electoral process is necessary "to fend off the advancing culture of death!," on her blog:
Over the years I have heard many priests and ministers argue that one of the reasons they do not speak about elections or particular candidates is that to do so would be a violation of their tax status. In other words, legal minds have advised these men of God that there is a price to be paid for preaching the truth when it involves the direct references that must be made to particular campaigns or political questions such as ballot initiatives and the like. What this fear of the IRS has created is a sea of ignorance as people who go to church are not hearing the facts in these critical matters.

Matt Staver of Liberty Counsel has chosen to do something about this....The reputation of Liberty Counsel is undeniably one of unquestionable loyalty to the Lord and Biblical teaching.

In the latest iteration, Staver makes several items available on his Liberty website

- A One-Page Letter for Pastors and Christian ministry leaders;

- A Four-Page "Legal Memorandum", Pastors, Churches and Political Activity;

- An older online memo on Distributing Nonpartisan Voter Guides in Churches

- A check-off guide of Political and Legislative guidelines for Pastors and Churches

- A link to a 24 minute DVD in which Staver speaks about Pastors and Political Acitivity, this time interspersed with pictures of Biblical quotes, fetuses and the like;

- A church bulletin insert, Christians Must Vote, from WallBuilders

- Six separate downloadable voter guides, three from Faith 2 Action, others from WallBuilders, Florida Family Policy Council and Mike Farris.

On the DVD, a more polished and scripted version of uploads in my prior post, Staver warns that pastors of churches "receive threatening letters from groups like Americans United for Separation of Church and State, or maybe even the ACLU" telling them that they are violating the law because of political activity (a screen says activists groups "hassle churches"), and that pastors consequently feel intimidated.

To explain why pastors must get involved in electoral politics for the Religious Right, he quotes proverbs: "When the righteous rule, the people rejoice; when unrighteous people are in office, the people moan." (The screen tells us, Proverbs 29:2 NIV, with a slightly different version: "When the righteous thrive, the people rejoice; When the wicked rule, the people groan.")

Staver insists that pastors must overcome "vocal laryngitis" and exchange it for "a megaphone" to send people to the polls for Biblical values. Why? "The sanctity of human life is in the balance," he states, while a screen declares "pastors MUST TAKE a responsibility to inform their churches on candidates who stand for life and other issues."

These efforts to push Religious Right voters to the polls will, no doubt, continue. Wallbuilders, which has a block of links to Liberty Counsel's advice and other literature, notes that a complaint had been filed about its voter guides. But, it says: We will not be intimidated.

All this "free" advice to clergy about what is and is not permissible under the tax laws makes me think that perhaps we on the left end of the spectrum should do all we can within those same laws to speak out. If it's good for the goose, it should also be good for the gander, right?

Of course, if we were to do that, can you imagine how hard their own lawyers would hit back with the same kind of "intimidating" and "threatening" actions?

Laura Flanders points to progressive nonprofit organizations as being too timid in speaking their minds at election time in the current issue of The Nation. In an article titled Raise the Bar, she writes:


This extended primary season offers an unusual period in the sun for progressives, but it's not enough to bask. Activists must raise the bar on policy and barter their support for some solid commitments.

Scared of losing their tax-exempt status, many groups sit out elections. (Boy, how the IRS keeps us in line!) But nonprofit 501(c)(3)s can publish voter guides, scrutinize the contenders' records and help their members push the candidates on their platform pledges. (emphasis added)

501(c)(3)'s can publish voter guides, but they can't be "biased" (its probably better if they just don't publish them).  501(c)(4)'s can do all the things that Flanders is writing about, but they aren't tax-exempt.  Since 501(c)(3)'s are often single issue, or bi-partisan, in focus, I can't see why they would want to get directly involved in campaigns.  They might alienate large numbers of their supporters.

The Religious Right American Center for Law and Justice has also published a handy guide for churches, here.  entitled "Churches, Free Speech and the Regulations of the IRS Regarding Elections" starts out with the definitive lines:
1. CHURCHES MAY SPEAK OUT ON THE MORAL ISSUES OF THE DAY.  
A. A Primary Purpose Of The Church Is To Influence The Culture Through Advocacy Of Moral Issues.
B. The First Amendment Protects Churches' Right To Speak Out On Moral Issues Of The Day.

The IRS came down on it due to an anti-war sermon by an emeritus preacher. Preacher castigated both Bush for starting, and Kerry for approving, the Iraq war. The theme was "Jesus would be disappointed in both candidates". (uh..duh! they are politicians!)

It took about 3 years to clear up with the IRS, who gave them a pass.

Liberty Counsel offers representation to the Religious Right for free, as does Alliance, ACLJ and James Madison. They raise millions of dollars in funds to litigate for the Religious Right -- handy, indeed.

As Liberty says in its letter to pastors, "To help you fulfill your high calling to fearlessly speak the truth, Liberty Counsel provides free information ... As a nonprofit ministry, Liberty Counsel provides free legal advice and representation."

Hmmm ... maybe progressive churches can call on them to support their "fearlessly speaking" too ... and see how willing they are to assert Biblical/worldview discrimination.

The James Madison Center for Free Speech, a group with ties to the National Right to Life Committee and headed by its counsel, James Bopp Jr., has kindly offered advice to right-wing and anti-abortion pastors on help congregations vote for the Religious Right.

An 8-pager, "Constitutional Protection for Pastors," dated September 2007 and co-published with the another similar group, the Alliance Defense Fund, is subtitled: Your freedom to speak Biblical truth on the moral issues of the day.  It, too, warns of the "scare tactics" of groups such as Americans United for Separation of Church and State, which it said, is sending "misleading letters to churches."

The James Madison Center also has a 3-page set of 'Do's and Don'ts' for pastors.
