Randall Terry's Superbowl End Run

Last year, Republican anti-abortion militant Randall Terry changed parties and announced that he would run in the Democratic primaries against Barack Obama.  His aim was to exploit a provision in federal law that requires television stations to air uncensored ads for candidates within 45 days of an election. Terry, acting as campaign manager for a GOP candidate for Delegate from the District of Columbia had previously tested the situation and had been able to air gory fetus antiabortion ads in the DC market.

His stated goal was to be able to air similar ads during the Super Bowl.  He has already aired a few ads in Iowa, New Hampshire, and Boston -- and wants to run ads during the Super Bowl in 40 cities in 17 states where there will be Democratic primaries and caucuses within the 45 day window.  (In a fundraising letter (PDF) he names the stations in the cities where he would like to be able to buy ads.)

He claims to have already ordered "nearly 10" ads in Minnesota.  He has not announced any other ads buys, and it is unclear whether he will be able to raise the money for them. (PDF).

Terry has sample ads on his campaign web site, and says he plans to unveils a new ad for the Superbowl.

But Terry is also recruiting other candidates for federal offices for the same reason -- not to win  elections but to exploit the law to run graphic antiabortion ads on television.  The Hill reports that Gary Boisclair, who is running against Rep. Keith Ellison (D-MN) is already using his status as a primary challenger to run antiabortion ads.

This may well be just the beginning.

I dislike Randall Terry, this is a pretty smart move on his part to get his ads on TV.  Goes to show you that having brains doesn't go with being good or right.

Credit where credit is due, however, to Howard Phillips, running as the US Taxpayers Party (now, Constitution Party) did it in 1992 in Iowa.  I actually saw one on my motel TV while in state for another reason at the time. I read in one of the clips about Terry's current project that litigation over gory fetus/candidate ads were found by the US Court of Appeals in 1996 not to violate what is essentially a porn exception to the law.  So Terry seems to be on solid ground, legally speaking.   While it strikes me as significant that he is doing this and having what small success he has had, it is also significant that he has not been able to make more of the opportunity than he has.  

He was unable to raise the money for a national ad buy, and he has only been able to purchase a few ads on local stations in Minnesota so far.  So the project could belly flop.  But even if it does, it will have made enough of a splash to make the point that this is a path that is open, if antiabortion militants want to pour enough time and money into it.

This might turn out to be a positive... if the ads anger enough people to motivate them (like to get out and vote).

His goal was to take advantage of a federal law that requires television stations to air uncensored ads from candidates close to an election. CBD vs THC Terry had already put this to the test by airing gruesome anti-abortion ads in the DC market. His actions speak to his courage and commitment to his cause.
